They're not doing a recall. If it was a
recall all stock would be withdrawn from shops and replaced.

Only if you know about the replacement scheme. If you don't you'll still have the sub-par disc.
And yes, a lot of blind buyers will be forever non the wiser and live their lives blissfully unaware of the discs shortcomings, so no harm done etc...
