I believe (I may be wrong though) that Miramax did try and make it first, but were trying to buy up the sports series (can't remember the characters name) at the same time, but the whole deal fell through, so Coben sold it to Canet's team.
Anyway, on point (slightly), it really bugs me when people get up in arms about what they call a remake, when in fact it's just a new adaptation of some source material, rather than remaking a film.
People wouldn't class the new Spider-Man as a remake of Raimi's one, so why do it to other source materials?
