You can't exert copyright over a single word, in this case 'Phantom', and besides, the makers of any version of Phantom of the Opera can't complain as all versions are based on the book by Gaston Leroux which is in the public domain.
If on the other hand it was nicking songs from the Lloyd Webber version then there would be a case to answer as that will have it's own copyright due to the original material involved.
